'Photo Cop' Challenge Could Affect Citations

People accused of "photo cop" violations can wait to settle their citations until after a judge rules on a civil liberties challenge, officials said.
Minneapolis installed 16 cameras at intersections across the city last year. The cameras take pictures of cars that run red lights, and police send a $142 ticket to the owner of the car.
An American Civil Liberties Union of Minnesota attorney is representing a vehicle owner who was ticketed but claims he was not driving the vehicle at the time of the violation.
ACLU-MN claims the photo-cop process violates due process rights and conflicts with state law, and a motion to dismiss the ticket was filed.
A pretrial conference in the challenge was scheduled for April 14, and a ruling on the motion to dismiss the citation is expected at that time.
Vehicle owners who wish to wait until after the ruling to settle photo-cop tickets can request to be arraigned on May 5, ACLU-MN said.
The continuance must be requested in advance, and ACLU-MN advised ticket holders to arrange the continuance with a court clerk or hearing officer.
