Felony Charge Dropped In 11-Year-Old Boy's Death

SHAKOPEE, Minn. (WCCO) ― Prosecutors dropped a felony charge against a Prior Lake, Minn. man accused in a hit-and-run that killed an 11-year-old boy.

The charge of criminal vehicular injury was dropped after blood alcohol results came back showing Randal Hennes, 40, was actually under the state's legal limit of 0.08 when he ran into Nicholas Hagadorn in Shakopee, Minn.

Hennes' BAC was only 0.07 when the July 7 incident happened.

Hennes still faces a felony charge for failure to stop for an accident involving another person.

Hennes has had two previous DWIs.

If convicted, Hennes faces four years in prison and an $8,000 fine. If the charge hadn't been dropped, Hennes may have faced up to eight years in prison.
