The court has weighed in on a lawsuit over the death of Grant Jestus -- a 5-year-old whose 2003 drowning prompted a state law requiring children under 10 to wear life jackets while boating.

The mother of a Blaine drowning victim can go after her ex-husband's insurance company under a new ruling from the Minnesota Court of Appeals.
The court has weighed in on a lawsuit over the death of Grant Jestus -- a 5-year-old whose 2003 drowning prompted a state law requiring children under 10 to wear life jackets while boating.
Grant's father, Michael Jestus, had a State Farm boatowner policy that excluded residents of his household.
But the court says Grant didn't legally live in his father's household. His mother, Kimberly Jestus, had sole physical custody.
The unpublished ruling overturned an Anoka County District judge's decision but does not set a precedent for future cases.
