The Bureau of Criminal Apprehension says a 10-year law enforcement veteran was in an unmarked vehicle and wearing plain clothes when he shot 24-year-old Tyler Heilman (pictured).

A county prosecutor says the Le Sueuer County deputy who shot and killed an unarmed man in swim trunks last summer is backed up by an impartial eyewitness and other evidence gathered at the scene.
Assistant Anoka County attorney Andrew Johnson looked into charges in the July 20 death of Tyler Heilman, which started after deputy Todd Waldron pulled him over for driving erratically. The confrontation quickly escalated into a struggle that ended with Waldron, in plain clothes, fatally shooting Heilman.
A grand jury recently declined to bring charges against Waldron.
Heilman's family says Waldron overreacted. But Johnson says another witness reported that Heilman was getting the upper hand in the fight and that he appeared to reach for the deputy's gun before Waldron shot him.
A lawyer for Heilman's family members say they are conducting their own investigation.
